Authorisation Guidelines for the Department of Environmental Affairs & Tourism
Manual for drafting legally robust and monitorable authorisations

The Department of Environmental Affairs and Tourism has appointed the Environmental Evaluation Unit and Cheadle, Thompson and Haysom Attourneys to compile a manual for drafting legally robust and monitorable authorisations.  The main objective of this manual is to assist case officers and decision makers to compile authorisations that are less open to legal challenge, and which can be more easily enforced and monitored. 

The main authorisations that the consulting team will cover in the manual include:
a) Environmental Authorisations issued in terms of  the National Environmental Management Act
b) Authorisations issued in terms of air pollution and waste management regulations and conventions.

In summary, the main tasks that the consulting team will undertake are as follows:

  1. Research and report on current authorisation processes, covering aspects such as best practice and particular problem areas that need to be addressed;
  2. Hold a workshop to discuss the findings of the above research and draft an outline of the manual;
  3. Compile the manual and test its effectiveness;
  4. Promote and distribute the manual.
